Sie müssen einen Ausweis haben, da wir gelegentlich die Grenzen überqueren können. Jeder Wunsch von speziellen Bedingungen seitens der Käufer muss an der Geschäftsführung gebeten sein. Dann wird „Mon Tour Motos“ ihn zustimmen und diese Anfrage wird nur erst bei schriftlichen Einverständnis freigegeben sein.

1) General conditions and terms

mandated  by order of the prefecture of the Isere dated 13 February 2009

The company "MON TOUR MOTOS SARL au capital de 8000 €, 50 rue de la Montat 42100 Saint-Etienne - RCS Saint-Etienne 509 878 393 0001 6 - whose managing director is Henri LAVIGNE,

to sell the tours organized by the company ADAPTOURS.

The company "MON TOUR MOTOS” will accompany customers throughout the travel, from the reception, on the road on a bike, and until the split up at the end of travel, as an agent of a travel agent. The company provides commercial part and will be your single contact before, during and after the stay.

Pursuant to articles L211-8 and L211-18 of the French Code of Tourism, the provisions stated in below mentioned articles R211-5 through R211-13 of the same Code of Tourism do not concern the booking and sale of tickets which are not comprised within the framework of a travel package.  Article R211-7 of the French Code of Tourism concerns the preliminary information handed out to the Purchaser: the Operator’s brochure, as well as a quoted proposal. Consequently, unless otherwise specified, the characteristics, conditions and fares as indicated on the website prevail, and they will be considered as approved upon signature of the contract. As stated in article R211-7 of the French Code of Tourism, a detailed programme is the preliminary information given to the Purchaser.
In the event of a transfer of contract, the concerned parties must pay an additional fee. Supporting documents will be provided for any amount exceeding the quotes posted at the point of sale and mentioned in the contractual documents,

The general conditions of sale are those of Decree No. 2007-669 of 2 May 2007 laying down the conditions for conducting activities related to the organization and the sale of travel or stays. They must appear with the registration form submitted by the travel agent.

Article R211-5: Subject to the exclusions mentioned in the second sub-paragraph (a & b) of Article L.211-8, any offer and any sale of travel services or stays entails the handing-over of appropriate documents meeting the regulations stated herein. In the event of a sale of air tickets or seats on a regular flight exclusive of any related services, the agent will hand over to the purchaser one or more tickets issued by the carrier under its sole responsibility and for the totality of the trip. For customized bookings, the airline’s name and address must be mentioned. Invoicing the individual fare components of one same package does not unbind the agent from his/her obligations.
Article R211-6: Prior to the actual contracting and on the basis of a written document bearing his/her corporate identity, address and authorization number, the agent must notify the purchaser of the tariffs, dates and any other components of the trip such as:1) destination, characteristics, types of conveyors with their categories;  2) lodging facilities with their situations, comfort levels and main characteristics, as well as certifications and tourist rankings according to the standards and regulations in force in the host country;3) meals supplied;  4) itineraries for accompanied circuits; 5) administrative and health formalities, especially in the case of crossings of borders, and the time required for such formalities; 6) visits, excursions and other services included in the packages or possibly available at extra charge;7) if the trip/stay depends on the number of participants, the minimum or maximum group size required, and the deadline to notify the purchaser of a cancellation. In any event, the deadline cannot be less than 21 days before departure;8) the sum or percentage of the price to be paid as down-payment with the date limit for settling the balance;9) price adjustment procedures as provided for in article R.211-10; 10) conditions of cancellation of a contractual nature; 11) conditions of cancellation as stipulated in articles  R.111-11, R.211-12, and R.211-13 hereafter;  12) detailed description of the risks covered and warranty quotes contracted in the insurance policy with regards to the consequences of civil liabilities of travel agents or associations, non-profit organizations and local tourist institutions;13) information on any optional insurance policy purchase to cover the consequences of certain types of cancellations, or any other specific policy purchased, for instance a contract covering repatriation charges in case of an accident or disease.
Article: R211-7: The preliminary information delivered to the Purchaser binds the agent, unless he/she has expressly reserved his/her right to modify some of its terms. In that case, the Agent must specify in what circumstances and on what items the change take place. In any event, the modifications must be stated in writing and presented to the consumer prior to his/her signing the contract.
Article R211-8: The contract signed between the Agent and the Purchaser must be established in writing in two original copies signed by both parties, one of which will be handed over to the Purchaser. It must comprise the following clauses: 1) names and addresses of the agent, of his/her guarantor and insurer as well as name and address of the operator; 2) destination or destinations, and, in the event of a split stay, the various time periods with their dates; 3) types, characteristics and categories of the conveyors involved, with the dates, hours and cities of outbound and inbound destinations; 4) lodging facilities, their situations, comfort levels, main characteristics and tourist rankings according to the standards and regulations in force in the host country; 5) number of meals supplied;6) itinerary in case of accompanied circuits; 7) visits, excursions or other services included in the total price of the trip or stay; 8) the total price of services purchased with indication of any possible invoicing adjustment under the terms of the provisions of article R211-10 hereafter;  9) if relevant, indication of the royalties or taxes related to certain services such as landing, loading or unloading taxes in ports and airports, and visitor’s taxes when they are not included in the quotes. 10) the schedule of payments; in any event the Purchaser’s last payment cannot be lower than 30% of the price of the trip or of the stay; also, it must be settled upon delivery of all the travel documents;11) any particular conditions requested by the Purchaser and accepted by the agent; 12) measures entitling the purchaser to lodge a complaint with the agent for non or poor execution of the contract; the purchaser must make his/her claim to the agent in the shortest delay, via certified mail with acknowledgement of receipt, with copies to the tour operator and to the service suppliers;13) deadline for the agent to notify the Purchaser in case of cancellation when the trip is subordinated to a minimum number of participants (refer to the provisions stipulated in n°7 of above mentioned article R211-6);14) conditions of cancellation of a contractual nature; 15) conditions of cancellation stated in articles  R211-11,  R211-12 and R211-13 below; 16) detailed description of the risks contracted including the warranty quotes covering civil liabilities of associations, non-profit organizations and local tourist institutions; 17) information regarding any optional insurance purchased to cover the consequences of certain cases of cancellation (policy number and insurer’s name), as well as any assistance policy purchased for additional coverage, concerning for example, repatriation charges in case of an accident or disease. In that case, the Agent must hand over to the Purchaser a document stating the risks covered and those excluded. 18) deadline for the Purchaser to notify the agent in case of a contract transfer.19) agent’s pledge to provide the purchaser in writing with the information below, at least 10 days before the date planned for departure; a)      name, address and telephone number of the agent’s local representative, or failing this, the names, addresses and telephone contacts of local organizations likely to assist the purchaser in the event of difficulty, or, failing this again, the call number permitting to contact the agent; b)      whenever minors are concerned, a telephone number and address permitting to contact the minor or the person in charge.
Article R211-9: The Purchaser may transfer the contract to an assignee meeting the same conditions as he/she, and allowing him/her to take part in the trip or stay, as long as the contract has not yet been in effect. Except in case of a stipulation more favourable to the transferring party, within 7 days prior to the start of the trip, the Purchaser must inform the agent of his/her transfer decision via certified mail with acknowledgement of receipt. For cruises, the deadline is extended to 15 days. In no circumstances is the transfer subjected to prior approval by the agent.
Article R211-10: When the contract comprises the express possibility of a tariff adjustment, within the limits provided for in article L.211-13, the calculation methods of price variations, upwards and downwards, must be accounted for, especially with regards to transport charges and their related taxes, currencies which can affect the price of the trip or the stay, as well as the rate of the currency chosen as the reference calculation on the contract.
Article R211-11: When, prior to departure, the agent is forced to change one of the essential elements in the contract such as a significant price rise, he will inform the passenger without liability for compensation, via certified mail with acknowledgement of receipt. Consequently, the Purchaser may; -    either terminate his/her contract and obtain immediate reimbursement of the sum paid; -    or accept the agent’s proposal for substitute services, in which case the contract will be endorsed then signed by both parties; any reduction in price will be deducted from the balance due, and if the sum already paid exceeds the new price, the surcharge will be reimbursed to the Purchaser before his/her departure.
Article R211-12: In the case provided for in article L.211-15, when, prior to the departure of the purchaser, the agent cancels the trip or the stay, the latter must notify the purchaser by certified mail with acknowledgement of receipt. Without foreseeing a possible claim for compensation, the Purchaser shall obtain immediate reimbursement from the agent without penalty. The Purchaser is then entitled to an allowance at least equal to the penalty he/she would have paid if he/she had initiated the cancellation. The provisions of this article do not dot exclude any amiable arrangement by which the Purchaser would accept a substitute trip or stay proposed by the Agent.
Article R211-13: When, after the departure of the purchaser, the agent is unable to provide most of the services contracted and paid for by the purchaser, without foreseeing a possible claim for compensation on the Purchaser’s part, the Agent must immediately make the following provisions:-    either propose substitute services while supporting any possible additional charge and, if the services accepted by the Purchaser are of lower quality, the agent must pay for the price difference upon the purchaser’s return. -or, if there is no alternative or if the substitute services are turned down by the Purchaser for valid reasons, provide the Purchaser, at no additional charge, with tickets entitling him to a flight home or to the destination of his/her choice in similar conditions, primarily agreed upon by both parties.

2) Conditions of sale

Registration

Registration for a journey is done via a registration form or contract. It implies the approval of general and special conditions. The registration will become effective upon receipt by us of the registration form signed by the customer, and accompanied by a deposit of 50% of the journey’s total cost. The application must be signed by the customer if he is major or if the customer is a minor by his legal representative, with specific description of his quality and details.

Registration of the customer will be done according to the following procedure:
1) The client shall fill in the online booking form (one per motorbike) on our website:
www.mon-tour-motos.fr
2) The payment of a deposit of 50 % of the amount of the travel is required:
• by check (payable to "MON TOUR MOTOS” - 50, rue de la Montat - 42100 Saint-Etienne France).
• or by bank transfer (IBAN: FR76 1680 7001 5331 7165 6021 864 - BIC/SWIFT: CCBPFRPPGRE).
3) Upon reception of your deposit of 50% of the total amount. The company "MON TOUR MOTOS" shall confirm your registration by postal mail, with  two copies of the detailed registration form (dated and signed).

Prices and services

Prices include all taxes in Euro. They include the services listed on the estimate, invoice or pro forma. These prices are lump sums. No dispute about the price of a journey will be taken into account after the journey. The customer has the responsibility to check before his departure that the price suits him. These prices are likely to readjustment in the event of significant changes regarding:
safety tax, port and airport Tax, increase of fuel prices, changes in the exchange rates, significant increase in hotel prices. The standings of accommodation are given according to local standards. For example, an Austrian youth hotel may be of better standard than an Italian or Spanish 2 stars hotel. The terms and rates of our journeys are defined according to the number of nights spent on site. Breakfasts, when they are included, are meant after a night's lodging.

The price of the journey includes:

• A welcome gift
• A welcome aperitif
• Half board journey (3 or 6 or 7 or 8 dinners, nights in double room, breakfasts).
• Flat fee drinks during dinners. 
• Guidance on the road (except for Freedom package).
• Luggage transportation for trips between accommodation (if group of more than 10 people).

The price of the journey does not include:
• The lunches.
• the individual room or twin room with two small beds (if available). The supplément is € 20 (Comfort category) or € 30 (Premium category) per person and per day.
• The possible daily tourist tax (that you pay directly to the hotel as well as well as your extras and incidental expenses).
• The price of your entrance tickets for visits, that "Mon Tour Motos" will suggest ,and subject to acceptance by the majority of the group.
• Your daily drinks.
• Airport, railway station, ferry ... pickup.
• Motorbike, Fuel and any possible highways tolls.
•Comrehensive insurance (cancelation, loss/theft of luggage, repatriation, car assistance).


Payment

No registrations will be accepted unless accompanied by a payment of 50% of the total amount of the journey.
The remaining 50% will be sent no later than 1 month before departure (date of postmark as proof). No prior notice will be done by MON TOUR MOTOS.
Payments may be made by check payable to MON TOUR MOTOS, or bank transfer (IBAN: FR76 1680 7001 5331 7165 6021 864 - BIC/SWIFT: CCBPFRPPGRE), or in cash when possible, or by credit card with an extra commission of 1 %.
A registration for a journey which remains unpaid within the provided period shall be deemed void and suffers cancellation specified in the paragraph dealing with cancellation.


Breach of contract / change of name

In accordance with the provisions of articles L 211-9 and R 211-12 of the Code of tourism, the customer may assign his contract to any person eligible for travel and journey. Prior information will have to be given, by the original customer via a registered letter sent to MON TOUR MOTOS at least 7 days before the journey.
Concerning formulas including air transport, agency fees of 30 € will be passed on the customer and will have to be added to airline or company car’s own fees.


Documents / papers / formalities

Participants who choose to travel have all necessary documents at the time of departure (identity card, motorbikes driving license, passport, visas, vaccines ...). Information on the necessary documents (passports, visas) is for illustrative purposes only. These formalities may change at any time and remain in all cases under the responsibility of the participant. Attention, contrary to popular belief, an expired passport, or driver's license, does not count as ID card, even in the European Union. The unaccompanied minor must have a valid ID and a parental permission to leave the territory covered by the relevant authorities. If he travels with his parents, he must have his own passport. He must also have a valid identity card. A participant who chooses a journey in a country where an entry visa is required must, in this case, take care of the required formalities by contacting the consulate or embassy of the visited country. The customer is also responsible for transit visas. Get in touch with us in order to know the itinerary. All formality costs must be paid by the participant. MON TOUR MOTOS may under no circumstances be held liable for issues that arise at the border, including loss or theft during your journey. The bus cannot wait for you if you are detained by the police; customs or other ... The possible cost regarding your trip back will be at your expense. All other formalities (vaccines, military ...) are under your own responsibility.


Cancellation

> By the participant
All cancellations must be made to MON TOUR MOTOS via a registered letter with acknowledgement of receipt, postmark as proof. If the customer cancels all or part of his journey, for whatever reason, MON TOUR MOTOS will retain a part of the amount already paid according to the cancellation date. The scale is as follows (percentage of the total amount including the costs without insurance per person):
• More than 30 days before departure: € 100 per person (agency fees) - 35 % per person if customized Tour.
• Between 30 and 21 days before departure: 40% of the total amount - 50 % per person if customized Tour
• Less than 20 days before departure: 90% of the total amount.
• No show at the start: 100% of the total amount.
The costs of the airline will also have to be added to this amount.
In all cases, the minimum amount retained for cancellation cannot be inferior to agency fees (100 € per person). Any trip interrupted by the participant for any reason is considered consumed and won't give any refund.

> By the organizer
The organizer may cancel a trip up to 21 days before departure date, for lack of participants reason (the trip should include at least 3 motorbikes or 5 people). The customers will be informed by registered mail with proof of delivery (acknowledgment of receipt). The organizer shall refund all the paid sums, increased by a € 80 credit ( for a 6 days trip, € 40 for a 3 days trip) to be deducted from another travel during the same year.


Disclaimer

The customer who takes part in an activity organized by MON TOUR MOTOS:
• must respect in force Highway Code of visited countries and cannot blame MON TOUR MOTOS for the consequences of disregarding it.
• His vehicle must be in conformity with French laws or with those of visited foreign countries.
• His vehicle must be in good condition and has recently undergone an overhaul. In any case, the organization of "MON TOUR MOTOS" cannot be held responsible for the disfunction of the latter. Any mechanical failure could in any way modify the program of the journey. No refund of any payments or compensation could be asked for (see conditions above mentioned).
• His vehicle is insured for the period of travel.
• Drivers must be at least 21 years old.
• The driver has got a motorcycle valid driving license (category A for the French) for more than 1 year.
MON TOUR MOTOS and its agents reserve the right to exclude at any time a person whose driving could cause serious disruption to the rest of the group or could jeopardize the safety of others or who would not respect in force legislation: aggressiveness, non-respect of others, excessive drinking or smoking cigarettes in the frequented establishments ... No compensation to the excluded person is due in this case.MON TOUR MOTOS disclaims any liability for activities conducted during the journey but not planned on the original program.
The programs are purely indicative and no claims or damages will be accepted if external conditions require a change of itinerary for whatever reasons: weather, safety, or any other imponderable.
The customer who drives is aware of the driving difficulty level regarding the itinerary for motorbikes, and of the requested level of skill to do it. The customer driver is the only one able to appraise his own ability to drive along these itineraries. In no case can “MON TOUR MOTOS" be held responsible for a possible fall or other inconveniences which could occurred due to an overestimation of the customer’s ability to drive.


Litigation

Any claim regarding a journey must be sent to the company via a registered letter with acknowledgment of receipt within 8 days after the date of return. After this time, there will be no follow up to requests. In case of dispute, the court of competent jurisdiction is Grenoble’s court.


Files / Photos

Under Law No. 78-17 of 06/01/1978, it is recalled that data requested to the Customer are required in order to process the order and are only intended for internal use by the Seller.

MON TOUR MOTOS might take photos and videos during the journey which might be used in brochures, websites and other communication tools.
Any participant already grants MON TOUR MOTOS the right to use his image for the above aims.


Insurance

We recall that our package journeys do not include any insurance. In order to prevent any trouble, we strongly advise you:
to subscribe to the insurance of your choice or to subscribe to our insurance proposed in option in cooperation with Generali and Europ Assistance: Insurance assistance / repatriation + cancellation + stolen luggage. The cost of this insurance is described in a small booklet that can be sent to you on your request. Be aware that insurance premiums are never refundable (in case of cancellation).
